COPYRIGHT AND INTELLECTUAL PROPERTY
On completion of the 'Set Price Package' contract, the copyright and ownership of the logo is handed over to the client. Clients will be responsible for trademark/copyright of their logo and market segment colour and the registration of any ABN, business names and domain names and the licensing of fonts. The client will not hold I Need A Logo responsible for any copyright infringement that occurs after design of the logo in the case that the company name is in use. It is the client's responsibility to research its company name to ensure that the name is not already in use or protected by copyright or trademark laws. Refunds will not be made in the case of possible copyright infringement.
I Need A Logo reserves the right to reproduce all logos designed by us in our promotional activities. Further, I Need A Logo shall be free to use any ideas, concepts, know-how or techniques acquired during performance of client services, for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and other items incorporating such information.
PAYMENT
Online PayPal payment is preferred. By this method I Need A Logo will at no time hold a record of your credit or debit card details. Please read terms and conditions regarding secure payments and privacy. I Need A Logo accepts orders from any country in the world, via the PayPal payment gateway system. All packages are displayed in (AUD) Australian Dollars. All non Australian Dollars payments must be made by Pay Pal. Full payment must be made at the time of ordering and before physical delivery of the goods. I Need A Logo reserves the right to retain the full fee once the job has begun and design concepts have been shown to the client via email.
REFUNDS
Refunds are applicable only for logo design and stationery design. Refunds must be requested at the time of the submission of the initial design concepts. Once we begin making any alterations of changes to the initial design concepts, money will not be refunded.
All requests for a refund must be made:
1) at the time the initial design concepts are sent to you for review, and
2) must be made within 7 days of sending the initial design concepts to you.
SERVICE
All logo designs will be revised as many times as required with in the 12 hours that have been allocated to the design of the logo, after which a small hourly charge will occur, depending on the scale of the alterations. Stationery designs come with 1 round of changes only, after which a small hourly charge will occur, depending on the scale of the alterations. All correct stationery details must be supplied to I Need A Logo in an editable digital format, preferably an unformatted Word document.
I Need A Logo's initial logo design timescales can be negotiated at initial contact and are from receipt of funds to release of the initial logo designs. I Need A Logo will endeavor to perform all services in a fast manner, however timescales are to be taken as a general guide for our clients and are not part of the binding contract. This may be due to external factors outside of our control including, but not limited to, client's response time, workload influx or printer supplier delays.
I Need A Logo operates Monday to Friday, 9.30am until 6pm. We remain closed on Saturdays and Sundays, and major Australian public holidays. I Need A Logo is an online design service with our main communication preference being Email. We understand that if you wish to contact our staff by phone, you will not be charged any additional costs for this privilege. However, a small fee does apply if you wish to schedule a consultation meeting with our senior designers at a convenient location.
The output files of the final approved logo design will be delivered to the client via email in a compressed file format & on CD by mail at a later date, depending on the client's location (Australia only). Construction/working files remain the property of I Need A Logo and will not be distributed to the client or any other third party.
I Need A Logo will not be held responsible for delays caused by emails being directed to the clients ‘Spam' folder or bounced back from a full mailbox. I Need A Logo reserve the right to prioritise early paying clients and to charge urgency fees for expedited turnaround. The tailored package is available to clients at an hourly service rate, to be outlined and quoted to the client for approval before service is initiated.

- Greyscale (black and white print format) both normal design and reversed version
JPG Files (for internal use and web requirements) including:
- 72dpi resolution (at a small size)
- Web colour formats (RGB) both normal design and a reversed version
- Greyscale (black and white format) both normal design and reversed version
AI Files (for external print requirements, with rescaleable vector graphics) including:
- Print colour formats (CMYK) both normal design and a reversed version
- Spot colour formats (one colour pantone for print) both normal design and a reversed version
- Greyscale (black and white print format) both normal design and reversed version
- (NB. Some designs can not be produced this way.)
PSD Files (with transparent background) including:
- 300dpi resolution, CMYK format for use in print.

LIMITATION OF LIABILITY
All terms conditions, warranties, undertakings, inducements and representations, whether express or implied, statutory or otherwise relating to the provision of services by I Need A Logo not contained in the Agreement are excluded and I Need A Logo will not accept liability for any loss or damage (including consequential loss or damage) however caused (whether by negligence or otherwise) which may be suffered or incurred or which may arise directly or indirectly with respect to the service.
If you provide I Need A Logo material or information to be used in any form, you hereby warrant that these do not infringe the rights of third parties and indemnify I Need A Logo against any action taken against I Need A Logo by any such third party.
WEBSITE RIGHTS
Although I Need A Logo wants to provide the best experience possible on our website, we shall not be held responsible for delays or any other problems which the client may experience with the web site at anytime. However, we will endeavor to fix any problems and/or barriers that may arise. I Need A Logo reserves the right to remove part or all of the web site and/or its content at anytime, which may be to edit and/or upgrade and transform all or part of the web site.

CONTRACT
The contract begins upon receipt the signing of the 'brief form' I Need A Logo. This may include the time required for payment to clear at a bank. The contract immediately ends upon the client receiving the final logo design files.
I Need A Logo reserves the right, in its sole discretion, to terminate the Service, at any time, with or without notice. In the event of such termination, I Need A Logo will work with the Customer to determine the amount of any refund (if any) to be paid to the Customer as a result of such termination. Should the Customer's use of the Service result from the Customer's material breach of the terms and conditions of this Agreement, or any other agreement to which I Need A Logo and the Customer are a party, the Customer shall not be entitled to any refund, unless otherwise mutually agreed upon by the parties.
The contract will also end by expiring 10 weeks after the date the contract began. No refunds will be given upon expiry of the contract. A job will be invoiced at 10 weeks if not sooner.
Once the contract has ended, all liabilities for alterations, changes, or errors become the responsibility of the client. I Need A Logo will not be liable for any reprint costs or damages of any kind resulting from any errors. Charges for alterations or changes made after client approval will be made at the discretion of I Need A Logo and the client shall be liable for any charges imposed. It is the client's responsibility to check all spelling and grammar on the brief before it is submitted and again at the approval stage before work goes to print. Alterations, amendments or changes to the design after the contract has ended can be made for an additional fee.
